IMPLEMENTATION OF ENERGY PROJECTS IN SPAIN: DEADLINES

 


In Spain, from a regulatory standpoint, the implementation of energy production plants requires several steps: 1) access and connection permits, 2) initial regulatory permit (generally including environmental evaluation), 2) construction regulatory permit and 3) operation regulatory permit.
In addition, construction and operation shall require permits from local authorities as any construction or operation of a facility. Furthermore, since those projects usually are in rural land, an additional permit from regional authorities must be obtained. Additional permits or accesses may be needed as regards water, roads, supplies, or other issues.
Obviously, the more steps the project achieves, the higher value the project has.
Current Spanish energy regulation provide certain deadlines so if they are not met, the access and connection permits expire, losing all steps taken.
When speaking about access permits obtained after the coming into force of Royal Decree-Law 23/2020 (June 26th, 2020), pursuant to this RDL, as amended by further RDLs (RDLs 29/2021, 5/2023 and 8/2023):

- Access permits expire if the connection permit is not obtained in 6 months counted as from the coming into force of the RDL 23/2020 or the date of the granting of the connection permit.

- In addition, access permits expire if, from its date on, the Project does not achieve the following deadlines:

1.- Admission of the application for the initial regulatory permit: 6 months.
2. Favourable environmental impact declaration: 31 months.
3. Initial regulatory permit: 34 months.
4. Construction regulatory permit: 37 months.
5. Operation regulatory permit: 5 years.
